Starting Your Online Business – The Idea and the Legal Matters

The Idea

The first thing that you need to start your online business is an idea that you believe in. This means that you need to have a product or service, a concept of how to sell it, good content ideas for your Web site, and the belief that you can make it all work. If you don't have all these things in place, you may be wasting your time and money and setting yourself up for a disappointing failure.

You need to have a business plan in place that is going to successfully implement your idea with your product in such a way that you can take it from start to finish with very definite milestones along the way. Your business plan should include your budget, a time frame within which to work, your product or service inventory, and other financial matters. If you're unsure of how to write a business plan, you should consult with someone who has some experience writing such a plan.

The Legal Matters

Make sure that you have all the legal information that you need to start your business online. You don't want to find out at a later date that you've overlooked something important. Some of the legalities that you may need to consider include the following:

Incorporate or not?

Find out the legal benefits of incorporating your online business. There are benefits and disadvantages to incorporating your business that include taxes and matters of ownership. Contact a lawyer or tax accountant for more information about incorporating your business. Other options may include sole trader and limited liability corporations.

Copyrights/Trademarks.

It may not seem like an important factor, but liability issues surrounding intellectual property are something that you'll want to consider when you're doing business on the Internet.

Contracts and licenses.

Make sure that before you sign any contract you know exactly what you're signing and that you understand it fully. If you don't pay attention to contracts and licenses, you could end up being liable for any number of things, such as Web hosting regulations. There are several contracts that you might need to sign when you start your own business online that include hiring a Web site designer, a programmer, and/or digital certification. You will need a business license, which is typically administered through the local, county, or state government prior to commencing business.

Internet legalities

Make sure that you understand all the legal issues of doing business on the Internet such as the legalities behind obtaining a domain name. This is a dynamic and often confusing subject, so be cautious. For full blown legal advice it’s highly recommended to seek professional help (web developer, internet lawyer, etc.).
